Copyright & Intellectual Property Policy
How content on the ArtStay platform is owned, licensed, and protected, and how to report suspected infringement.
Copyright Overview
This Copyright & Intellectual Property Policy explains who owns the different kinds of content found on the ArtStay platform, how that content may be used, and how rights holders can report suspected infringement. ArtStay protects its own original work and respects the rights of artisans, vendors, partners, and third-party creators. Content on the platform generally falls into four groups: ArtStay-owned content, independently owned vendor and artisan works, licensed third-party materials, and traditional cultural knowledge that belongs to no single party.
ArtStay-Owned Content
Unless otherwise stated, ArtStay or its licensors own or control the rights in original materials created for the platform, including:
- Original website design, page layouts, graphics, and user interface
- Original text, editorial content, guides, and platform documentation
- Platform compilations and structured data, to the extent protected by law
These materials may not be copied, modified, distributed, or used commercially without ArtStay's prior written permission, except as permitted by applicable law.
Trademarks & Brand Identity
The ArtStay name, logo, taglines, and related brand elements identify ArtStay and its services. They may not be used in a way that suggests endorsement, partnership, or affiliation without written permission. Other names, logos, and marks that appear on the platform belong to their respective owners. ArtStay does not represent that any of its marks are registered in a particular jurisdiction unless that registration is stated separately.
Photography, Videos & Digital Media
Photographs, films, and other media on the platform may be owned by ArtStay, by the photographers or creators who produced them, by vendors and artisans who supplied them, or by third parties who license them. Appearing on ArtStay does not transfer ownership of any media to ArtStay or to other users.
Videos embedded from third-party services, including the ArtStay launch film hosted on YouTube, remain subject to the terms of the hosting service. Do not download, re-upload, or re-edit platform media without permission from its owner.
Kashmiri Artisan Intellectual Property
Individual artisans and craft enterprises retain the rights in their original designs, patterns, and finished works, including original photographs and written descriptions they create. Featuring an artisan or product on ArtStay does not transfer ownership of any design or work to ArtStay or to other users. ArtStay does not claim ownership of artisan creations, and reproducing an artisan's original design without permission may infringe that artisan's rights.
Traditional Knowledge & Cultural Heritage
Kashmir's traditional crafts, techniques, motifs, historical knowledge, and place names are a shared cultural heritage that belongs to its communities and craft traditions. ArtStay does not claim exclusive ownership of any traditional craft, technique, historical knowledge, or cultural expression.
Our editorial presentation of this heritage is protected only as to its original wording, images, and design, never as to the underlying traditions it describes.
Geographical Indications & Authenticity
Geographical indications, certification marks, and authenticity labels associated with Kashmiri products remain governed by applicable law and by the bodies that hold or administer them. ArtStay does not claim ownership of any geographical indication or certification, and it does not itself certify a product as authentic. Vendors are responsible for describing their products accurately and for any certification or label they display.
Vendor & Partner Content Rights
Vendors, service providers, and partners keep ownership of the content they submit, including business names, trademarks, descriptions, photographs, prices, and product or service details.
By submitting content, a vendor confirms that it owns the content or has the rights needed to share it, and grants ArtStay a non-exclusive, revocable license to host, display, and promote that content on the platform and in related marketing while the listing remains active. Vendors are responsible for the accuracy and lawfulness of what they submit.
Software, Technology & Platform Content
The platform's own code and configuration are owned by ArtStay or its licensors. The platform also uses third-party software, fonts, maps, and services that are provided under their own licenses and remain the property of their owners. Nothing in this policy grants a license to copy, decompile, or reverse engineer the platform, or to scrape or extract its data in bulk without written permission.
Permitted Use & Content Licensing
You may view the platform and share links to it for personal, non-commercial purposes. To use ArtStay-owned content beyond this, including for publication or commercial purposes, request written permission using the contact details below. For content owned by artisans, vendors, or third parties, you must obtain permission from the owner.
Where applicable law allows limited uses such as quotation, criticism, or news reporting, nothing in this policy restricts those rights.
Copyright Infringement Reporting
If you believe content on ArtStay infringes your copyright or other intellectual property rights, send a written notice to usa@kashmirartstay.com that includes:
- Your name, organization, and contact details
- A description of the work you claim has been infringed, and proof of your rights if available
- The exact web address (URL) of the material you believe is infringing
- A statement that you have a good-faith belief that the use is not authorized by the rights holder, its agent, or the law
- A statement that the information in your notice is accurate and that you are the rights holder or are authorized to act on its behalf
- Your physical or electronic signature
Takedown & Dispute Procedures
We review complete notices promptly. Where appropriate, we may remove or disable access to the material, notify the person who submitted it, and act on repeat infringers. Knowingly submitting a false notice may carry legal consequences.
If your content was removed and you believe this was a mistake or that you have the right to use it, reply to the same address with your contact details, a description of the removed material and where it appeared, and a statement explaining why you believe the removal was in error. We may share your response with the original complainant and may restore the material where appropriate.
Policy Updates
We may update this policy from time to time. The date of the latest revision appears at the top of this page. This page is a general policy statement and does not constitute legal advice.
